Criminal Law OverviewSex Offender Registration RemovalSouthern California Criminal Defense Attorney Serving Los Angeles, San Bernardino, Riverside and Orange CountiesHaving your name on California's Sex Offender Registry can result in harassment, and the loss of your job, apartment, home, children, and family. If you are required to register as a sex offender in California, you understand the stigma. You understand how our society demonizes people who have been arrested or convicted of any sex crime. Even people convicted of victimless crimes, such as lewd conduct and consensual sex between gay men, have been punished by having to register as a sex offender for the rest of their lives. Being relieved of the requirement to register as a sex offender is difficult to do and only possible in certain circumstances - but it can be done. Relief for Homosexuals Stigmatized as Sex Offenders as a Result of Consensual Gay SexThe American Civil Liberties Union was instrumental in amending California's sex offender registration law (a/k/a Megan's Law list and California Penal Code 290) to allow people, who were convicted of certain crimes under now-defunct laws prohibiting sodomy or consensual gay sex, to have their names removed from the sex offender registry. They will no longer be required to register as sex offenders or be listed in California's sex offender registry. Those already listed can request to be deleted from the registry. If you are currently required to register as a sex offender based upon a conviction related to gay sex, I can help you submit a declaration and documentary evidence to the Department of Justice. If your claim for removal from the registry has been denied, I can help you appeal the denial in court. Removal from the Registry Following a Certificate of RehabilitationIn certain cases, a Certificate of Rehabilitation may help relieve you from the requirements of registration under California's Penal Code Section 290. It also acts as an application for a pardon. A Certificate of Rehabilitation is a court order, which declares that you have been convicted of a felony or qualified misdemeanor and are rehabilitated. In most cases, your underlying sex crime conviction must have been cleared from your record through the expungement process before you are eligible for a Certificate of Rehabilitation. If your petition for a Certificate of Rehabilitation is granted, it is forwarded to the Governor by the court and constitutes an application for a pardon.
