In California, "legally intoxicated" is defined as a blood alcohol content of .08 or greater. Even if you were drinking, police still have to prove that you were legally intoxicated at the time you were arrested. That can be hard for the state to do even after administering a field sobriety test. Depending upon the facts of each case, potential defenses in a drunk driving case include:
