In California, "legally intoxicated" is defined as a blood alcohol content of .08 or greater. Even if you had been drinking and driving, police still have to prove that you were legally intoxicated at the time you were arrested. That can be hard for the state to do. Depended upon the facts of each case, potential defenses in a drunk driving case include:

  • Technical defenses based on the actions of the police when you were stopped or arrested.
  • Scientific defenses bases on the accuracy of the breathalyzer machine, the training of the officer and the timeliness of your test.
  • Defenses based on the arrest video. If you do not appear drunk in the police video and your blood alcohol content (BAC) was borderline, a jury may find reasonable doubt that you were intoxicated.
