The penalties you face for a drug possession charge will vary based on the type of drug, the amount in your possession, its intended use (personal or for sale), and whether there were extenuating circumstances, such as weapons possession or gang crimes involvement.
If your offense is relatively minor, or a first offense, you may very well qualify for an alternative to jail. Proposition 36 sends drug offenders to treatment and probation instead of prison and charges are dismissed after treatment is completed.
You can't qualify for Proposition 36 if you are accused of sale or manufacture of drugs, are charged with a violent crime, or had a prior conviction for a serious crime. Proposition 36 is still rather new so contact my office to talk about what constitutes a serious crime and whether your case qualifies for an alternative sentence.
