Three Strikes and You Need a Top-Notch Attorney

Californians were sold on a 3 Strikes Law—three offenses and you wind up in jail for 25 years to life—because they believed that it would remove the most violent offenders from the community.

That's not what has happened, however:

  • Many 2nd strike and 3rd strike offenses are non-violent offenses, such as burglary (even burglary of empty buildings) and drug possession.
  • In some instances, multiple crimes committed at the same time will meet the 3-Strike criteria.
  • Offenses committed ten or more years ago—with no intervening offenses—are counted.
  • Even juvenile offenses count.

If you have had one prior felony conviction and are now in court for any felony crime, you are in danger. If your prior strike was in the past 5-6 years, your sentence for a current crime, if convicted, could be doubled.

If you have had two prior convictions, even if one of them was 15 years ago or when you were a juvenile, you are facing a much longer prison term.
